Terms of Service

You must be legally capable of entering into a binding agreement in your jurisdiction in order to place an order through RomKart.

You may not use the website, RomKart services, or products for any unlawful, fraudulent, abusive, misleading, or unauthorized purpose.

RomKart offers:

• Hand-painted oil paintings
• Made-to-order artwork
• Hand-painted art reproductions
• Custom portraits
• Personalized paintings
• Other commissioned artwork

Each painting is individually created by hand.

Because every artwork is hand-painted, minor differences may include:

• Brushwork
• Paint texture
• Color
• Proportion
• Composition
• Fine details
• Edge treatment
• Paint thickness
• Surface appearance

These are natural characteristics of handmade artwork and are not considered defects.

Product photographs, mockups, digital previews, and reference images are intended to provide a visual representation of the artwork.

Unless a product page expressly states otherwise, RomKart paintings are supplied as unframed rolled canvas. Frames, stretcher bars, and hanging hardware are not included unless specifically stated.

Most RomKart paintings are made to order.

Production normally begins after:

• Payment has been received
• Required photographs or reference materials have been supplied
• Necessary order information has been provided
• Any required composition or preview approval has been completed

Normal production time is approximately 7–15 business days.

Large, highly detailed, complex, or heavily customized paintings may require additional production time.

Production time and shipping time are separate.

When you provide RomKart with a photograph, image, logo, design, text, artwork, reference image, or other material for use in a custom order, you confirm that:

• You own the material or have permission to use it.
• You have any required permission from identifiable individuals shown in it.
• Your requested use does not unlawfully violate third-party rights.
• The material and requested artwork are lawful.
• The material is not submitted for fraudulent or prohibited purposes.

You grant RomKart a limited license to access, crop, resize, edit, reproduce, and otherwise use the submitted material only as reasonably necessary to communicate with you, prepare a preview, create the artwork, process the order, provide customer service, and deliver the artwork.

Submitting material for a custom order does not transfer ownership of that material to RomKart.

You are responsible for providing clear and accurate order information.

• Reference photographs
• Names and dates
• Requested colors
• Clothing details
• Background instructions
• Composition preferences
• Orientation and size
• Subject placement
• Other customization requirements

RomKart will rely on the information you provide when preparing and creating your artwork.

Errors resulting from incorrect or incomplete customer instructions may not qualify as defects.

For custom portraits or personalized artwork, RomKart may provide a digital composition or preview before painting begins.

The preview may help confirm:

• Subject placement
• Composition
• Background
• Orientation
• General color direction
• Major requested elements

Approval of the preview authorizes RomKart to proceed based on that version.

Changes requested after approval may delay production, require additional work or fees, or become impossible after substantial painting has been completed.

A digital preview is not an exact representation of the finished physical painting.

RomKart may reasonably refuse, limit, or cancel an order because of:

• Incorrect pricing or product information
• Suspected fraud or unauthorized payment
• Payment failure
• Technical or inventory errors
• Unavailable materials
• An unlawful or prohibited request
• Intellectual-property concerns
• Incomplete customer information
• An inability to complete the requested artwork
• Shipping restrictions
• Other legitimate operational reasons

If RomKart cancels an order before completion, any payment collected for the canceled portion will be refunded where appropriate.

Prices are displayed in the currency shown on the website or during checkout.

Prices, products, sizes, promotions, discounts, shipping options, and availability may change without prior notice.

Full payment is required before production begins unless RomKart has expressly agreed otherwise in writing.

Payments may be processed through third-party payment providers. RomKart does not directly store complete credit-card information.

You may contact RomKart to request cancellation within 24 hours of placing your order.

Cancellation requests should be sent to studio@romkart.com and include your order number.

Custom portraits, personalized artwork, and hand-painted art reproductions may be classified as final-sale products and self-service cancellation may therefore not be available.

After 24 hours, or once production has started, cancellation may no longer be possible because materials, preparation, and artist time may already have been committed to the order.

Final sale products include:

• Custom portraits
• Family portraits
• Couple portraits
• Children portraits
• Pet portraits
• Personalized artwork
• Artwork made according to customer specifications
• Custom compositions
• Custom sizes or orientations
• Artwork containing customer-requested names, dates, or text
• Hand-painted art reproductions

Final-sale products are generally not eligible for return or exchange because of change of mind, personal preference, minor handmade differences, normal brushwork variation, or natural color differences.

Returns, refunds, exchanges, replacements, and damaged-order claims are governed by the RomKart Return & Refund Policy.

Customers are responsible for return shipping for eligible change-of-mind returns unless otherwise required by law or agreed by RomKart.

RomKart currently does not charge a restocking fee.

Shipping is governed by the RomKart Shipping Policy.

• Standard shipping for eligible rolled-canvas orders is free.
• Standard shipping is generally estimated at 10–15 business days after dispatch.
• Express shipping may be available for an additional fee.
• Express shipping is generally estimated at 3–5 business days after dispatch.

Express shipping affects transit time only and does not automatically shorten production time.

You are responsible for providing accurate and complete shipping information.

RomKart cannot guarantee an address change after an order has been packed or dispatched.

Additional costs caused by an incorrect, incomplete, or outdated address may be the responsibility of the customer where permitted by law.

International orders may be subject to customs duties, import taxes, VAT, brokerage charges, inspection fees, or local processing charges.

Unless expressly collected at checkout, such charges are generally the responsibility of the recipient.

RomKart does not control customs authorities and cannot guarantee the amount of any import charge.

The RomKart name, branding, website design, original written content, original product photography, graphics, logos, page layouts, and other original RomKart materials may be protected by intellectual-property law.

Unless permitted by law or authorized in writing, protected RomKart content may not be copied, reproduced, republished, distributed, sold, scraped, modified, or commercially exploited.

Third-party artworks, artist names, trademarks, logos, characters, reference images, and other third-party materials remain subject to the rights of their respective owners.

Purchasing a physical painting does not automatically transfer copyright, reproduction rights, licensing rights, merchandising rights, or commercial-use rights.

Private photographs submitted for custom artwork will not normally be publicly displayed without permission.

RomKart may use submitted photographs internally where necessary to prepare the artwork, communicate about the order, resolve customer-service issues, and process or fulfill the order.

Personal information is also handled in accordance with the RomKart Privacy Policy.

If you voluntarily submit a review, testimonial, photograph, finished-artwork photograph, or other content specifically for public use or publication, you grant RomKart a non-exclusive, worldwide, royalty-free license to use that content for website display, portfolio presentation, social media, marketing, and customer service.

This does not automatically authorize RomKart to publicly publish private reference photographs supplied only for creating a custom portrait.

Reviews and testimonials should reflect genuine customer experiences.

RomKart may refuse to publish or may remove content that is spam, fraudulent, unlawful, abusive, threatening, defamatory, irrelevant, infringing, contains private information, or violates platform policies.

• Interfering with website operation or security
• Introducing viruses or malicious code
• Unauthorized automated attacks
• Unauthorized access to accounts, servers, or customer information
• Fraudulent payment or identity information
• Impersonating RomKart
• Using RomKart content to mislead customers
• Unlawfully scraping protected website content
• Violating applicable laws or third-party rights

RomKart may use third-party services including Shopify, payment providers, analytics providers, email providers, social-media services, shipping carriers, and customer-service platforms.

These services may have their own terms, privacy policies, security practices, and availability rules.

The website may contain links to third-party websites or platforms.

A link does not necessarily mean RomKart endorses or controls that third party.

RomKart aims to keep the website accurate and available, but continuous or error-free access cannot be guaranteed.

Access may be interrupted or modified for maintenance, security, technical problems, legal requirements, platform issues, or operational reasons.

To the fullest extent permitted by applicable law, website information is provided on an “as available” basis.

Nothing in this section excludes warranties, guarantees, remedies, or consumer rights that cannot legally be excluded.

To the fullest extent permitted by applicable law, RomKart will not be liable for indirect, incidental, special, punitive, or consequential losses resulting from use of the website or purchase of a product.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

To the extent permitted by law, you agree to be responsible for reasonable losses, claims, damages, or costs caused by unlawful use of the website, violation of these Terms, fraudulent activity, unauthorized submitted materials, or infringement of third-party rights.

RomKart will not be responsible for delays or failures caused by events outside reasonable control, including natural disasters, severe weather, war, civil unrest, government restrictions, transportation disruptions, customs interruptions, strikes, carrier shutdowns, internet or platform outages, or major supply interruptions.

If any part of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will continue in effect.

If RomKart does not immediately enforce a provision of these Terms, that does not mean the provision has been waived.

RomKart may update these Terms from time to time. The current version will be posted on this page with an updated revision date.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law principles.

This governing-law provision does not exclude, restrict, or remove mandatory consumer rights or protections that may apply to customers under the laws of their place of residence.
